In this document, GRUPO MINISTRY S.A.S. and its brand Ministry Couture are jointly referred to as the “Company”.


2. Acceptance of these Terms and Conditions

By accessing, browsing or making purchases on the Website, the user (hereinafter, the “User”) acknowledges that they have read, understood and accepted these Terms and Conditions, as well as the Company’s Personal Data Processing / Privacy Policy and Cookie Policy.

If the User does not agree with these terms, they must refrain from using the Website.

The Company may modify these Terms and Conditions at any time. Changes will take effect from their publication on the Website. Continued use of the Website after the publication of changes will be deemed acceptance of such changes.


3. User registration and accuracy of information

The User may place orders as a guest or by creating an account on the Website, depending on the functionalities available.

By registering or making a purchase, the User undertakes to:

  • Provide true, accurate, current and complete information.

  • Keep their contact and shipping details up to date.

  • Diligently safeguard their login credentials (username and password) and not share them with third parties.

The Company shall not be liable for any misuse of access credentials by the User or by third parties to whom the User has provided such credentials.


4. Products, content and information on the Website

4.1. Products offered

The Website primarily sells men’s jeans and clothing, without excluding the possibility that the Company may, in the future, add other categories such as shorts, chino pants, T-shirts, caps and related accessories.

The essential characteristics of each product (materials, sizes, colors, care instructions, etc.) are described on the corresponding product page.

4.2. Images and colors

Product photographs and images are for illustrative purposes. Although the Company strives to ensure that they accurately represent the actual product, slight variations in color or texture may occur due to lighting conditions, photo editing or the settings of the User’s screen or device.

4.3. Availability and inventory

Product availability is subject to existing stock. In exceptional cases, a product may be out of stock after an order has been placed. If this happens, the Company will inform the User and may offer, as appropriate:

  • An exchange for another product of similar value;

  • A coupon or credit balance for future purchases; or

  • A refund of the amount paid for the unavailable product.

4.4. Prices

Product prices are expressed in Colombian pesos (COP) and include applicable taxes, unless expressly stated otherwise.

Before completing the purchase, the User will be able to see the total amount to be paid, including taxes, shipping costs and any other applicable charges.

The Company may change prices at any time; however, such changes will not affect orders that have already been confirmed and for which payment has been approved.


5. Purchase process

The general purchase process on the Website is as follows:

  1. The User selects the products they wish to buy and adds them to the shopping cart.

  2. The User reviews the cart contents (products, sizes, quantities, prices).

  3. The User enters the required shipping and billing information.

  4. The User selects one of the available payment methods and confirms their intention to purchase.

  5. Where applicable, the User is redirected to the payment gateway or financial entity to complete the transaction.

  6. Once payment is approved by the financial entity or payment provider, the order is confirmed and the Company prepares and ships the order.

The purchase order is considered completed when:

  • The User has filled in the purchase form and order confirmation; and

  • Payment has been authorized by the selected payment method.

If payment is declined, the Company is under no obligation to maintain product availability or ship the order.


6. Payment methods

The User may pay for their purchases through the methods enabled on the Website, including:

6.1. BOLD payment gateway

Through BOLD, the User may use different payment methods (credit and debit cards, bank payments and other electronic payment options).

The handling of financial information is carried out directly by BOLD under its own terms and security policies. The Company does not store or have access to full credit or debit card numbers, passwords or other sensitive financial data.

6.2. ADDI

The User may choose to finance their purchases through Addi or a similar entity, subject to the policies, credit evaluation, interest rates and conditions determined by such entity.

By choosing Addi, the User acknowledges that:

  • The credit relationship is established directly between the User and Addi.

  • Approval or rejection of the credit, interest rates, terms and fees are defined by Addi, without the Company’s intervention.

  • The Company will only dispatch the order once it has received confirmation of payment from Addi.

6.3. Sistecrédito

The User may also purchase products using financing offered by Sistecrédito, according to its own policies, credit evaluation, interest rates and terms.

The Company does not define or control the conditions of credit offered by Sistecrédito; it only ships the order once payment confirmation has been received.

6.4. Cash on delivery (COD)

The Company offers a cash on delivery option in certain eligible municipalities. Under this modality:

  • The User must prepay the shipping cost in order to secure the logistics management of the order.

  • The value of the garments is paid in cash upon delivery of the order.

  • A sales representative will contact the User after the order is placed to coordinate payment of the shipping cost and delivery details.

  • Cash on delivery is available only in selected municipalities; coverage may be checked via the Company’s customer service channels.


7. Shipping and delivery

7.1. Coverage and carriers

The Company ships orders throughout Colombia using partner carriers, mainly Interrapidísimo and Envía, without prejudice to the use of other courier companies when convenient.

All shipments are dispatched from Cúcuta, Norte de Santander (Colombia).

7.2. Estimated delivery times

Delivery times are counted from payment confirmation and may vary depending on the destination city, the carrier, weather conditions, public order situations or other circumstances beyond the Company’s control. In general:

  • Cúcuta, Villa del Rosario and Los Patios:

    • Orders on business days confirmed before 3:00 p.m.: delivery on the same business day, up to 9:00 p.m.

    • Orders confirmed after 3:00 p.m.: delivery on the next business day.

  • Rest of the Cúcuta metropolitan area: 1 to 3 business days.

  • Main cities in Colombia: 2 to 5 business days.

  • Other cities and hard-to-reach areas: 3 to 7 business days.

  • San Andrés and other special destinations: 7 to 10 business days.

These time frames are estimates and do not constitute a guarantee of exact delivery dates.

7.3. Shipping costs

The shipping cost will be informed to the User before finalizing the purchase and will depend, among other factors, on:

  • Destination city or area;

  • Package weight and volume;

  • Carrier selected.

From time to time, the Company may offer free shipping or special rates under specific conditions, which will be communicated on the Website or through promotional campaigns.

7.4. Risk of loss or damage

Once the order has been handed over to the carrier, the risk of loss or damage passes to the User, without prejudice to any claims that may be filed against the carrier and to the applicable consumer protection rights and warranties.

If the package is delivered with visible damage, tampering or signs of opening, the User is advised to immediately record this with the carrier (for example, on the waybill or delivery form) and to report the situation to the Company as soon as possible.


8. Exchanges, returns, warranties and right of withdrawal

The specific conditions for voluntary exchanges, returns, warranties, right of withdrawal and refunds are described in the Company’s “Exchanges, Returns, Warranties and Refunds Policy”, available on the Website.

In all cases, the Company will comply with Colombian consumer protection regulations, including those related to:

  • Statutory warranty regarding the quality, suitability and safety of products;

  • Right of withdrawal in distance sales, where applicable;

  • Chargebacks / reversal of payment in purchases made with electronic payment instruments, in the events foreseen by law.


9. Intellectual property

All content on the Website, including but not limited to texts, designs, photographs, images, logos, trademarks, graphics, videos, source code and other elements, is owned by the Company or used with the authorization of the respective rights holders and is protected by applicable intellectual property laws.

Reproduction, distribution, public communication, transformation or any other unauthorized use of such content is strictly prohibited, unless prior written consent is obtained from the Company or the relevant rights holder.

Use of the Website does not grant the User any ownership rights over the content made available on it.


10. Proper use of the Website

The User undertakes to use the Website in a lawful and appropriate manner, and specifically agrees not to:

  • Use it for unlawful purposes or purposes contrary to good faith or public order;

  • Attempt to gain unauthorized access to restricted sections, computer systems or data belonging to the Company or third parties;

  • Introduce or spread computer viruses or any other systems that may damage the Website or third parties;

  • Use the Website’s content for unauthorized commercial purposes.

The Company may restrict or block access to the Website for Users who violate these Terms and Conditions.


11. Personal data protection and cookies

The processing of personal data collected through the Website or in connection with the Company’s commercial activities is governed by its Personal Data Processing / Privacy Policy.

The use of cookies and similar technologies is described in the Cookie Policy.

By using the Website, the User acknowledges and accepts these policies.

13. Governing law and jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Colombia.

 

Any dispute arising out of or in connection with the use of the Website or purchases made through it that cannot be resolved amicably shall be submitted to the jurisdiction of the courts of the Republic of Colombia, without prejudice to any proceedings that may be brought before the competent consumer protection authorities.
